Is Zahid Hamidi Really Free?

This must be the happiest day for Deputy Prime Minister Ahmad Zahid Hamidi because he has been discharged of the 47 charges with regards to Yayasan Akalbudi.

Although Ahmad Zahid Hamidi and the citizens of the country think that he is free, this is not the case. He still hasn't been acquitted which means that there is still no verdict to his case. He may be found guilty or not guilty when the case is brought back to court. He can still be charged for the same crime. This latest development in Zahid Hamidi's case doesn't indicate that he's innocent or guilty of the charges yet.

Why did the AGC halt Zahid Hamidi's graft trial?

The prosecution has applied for a Discharge Not Amounting to Acquittal (DNAA) and to stop the trial for 11 reasons. The defence pushed for a direct acquittal which was rightfully rejected and the court has granted the DNAA. What is a DNAA?

Ahmad Zahid Hamidi has been given a DNAA which means that once the prosecution has completed their investigation to the new evidence that was raised by the defence, he will surely be brought back to answer to the charges. 

He is not yet free much less innocent of the charges. He is still presumed innocent though. We just need to wait for the AGC and the MACC to complete their investigations. We don't want to deny Ahmad Zahid Hamidi the right to justice, do we?

How long does the AGC has to bring the case back to trial?

The statute of limitation is the time limit that is given for a plaintiff to bring a claim to court. For contractual or tortious claims, the statute of limitation is 6 years. There is no limitation period with regards to criminal, disciplinary or matrimonial cases. Therefore, Zahid Hamidi's case will remain open indefinitely.

Time is on the AGC's side to prepare his case thoroughly and to make certain that the outcome will satisfy both the courts and the country.
